Tribunal upholds Tinubu's election

THE National Assembly/Legislative House Election Petition Tribunal sitting in Lagos yesterday upheld the election of Mrs. Oluremi Tinubu, the Action Congress of Nigeria (ACN) candidate for the Lagos Central Senatorial District.

Ruling on a motion on notice brought pursuant to paragraphs 18 and 47 of the 1st Schedule to the Electoral Act, 2010 (as amended) filed by Chief Wole Olanipekun (SAN), counsel to Tinubu, the Tribunal Chairman, Justice Maurice Eneji, dismissed two separate petitions filed by the Labour Party (LP) and its candidate, Mr. Oladapo Durosinmi-Etti, for being incompetent.

The LP and Mr. Oladapo Durosinmi-Etti, its senatorial candidate for the Lagos Central Senatorial District, had in two separate petitions challenged the non-appearance of the party's logo on the ballot papers, and urged the tribunal to annul Tinubu's election and order a re-run.

But the tribunal in two separate rulings held that the LP and Durosinmi-Etti failed to comply with paragraph 18 (1), (2) and (4) of the Electoral Act which states that application for pre-hearing notice shall be by on motion and not through a letter to the tribunal.

The tribunal noted that the petitioners merely wrote a letter to the Secretary to the tribunal in applying for pre-hearing session, adding that the letter did not comply with the provision of the Electoral Act.
